1. About LicenseeFinder

LicenseeFinder is an information and comparison tool that helps Australian financial advisers search, compare and evaluate Australian Financial Services (AFS) Licensees. It draws on public information from ASIC registers and on information provided by licensees themselves.

2. Not financial, legal or professional advice

The Service provides general information only. It is not financial product advice, legal advice, tax advice or a recommendation to engage, or not engage, any particular AFS Licensee. Nothing on the Service takes into account your objectives, financial situation or needs. You should make your own enquiries and obtain independent professional advice before making any decision about an AFS Licensee or your authorisation arrangements.

3. Eligibility and accounts

The Service is intended for financial advisers and industry participants. To access certain features you must register using a valid email address. We use passwordless (magic-link) login, so access to your account depends on access to your email — keep your email account secure. You are responsible for activity that occurs under your account, and you must not share your access link with others.

4. Acceptable use

When using the Service, you agree that you will not:

• use the Service in any unlawful way or for any unlawful purpose;
• scrape, harvest, data-mine or bulk-extract content or data, except as expressly permitted by us in writing;
• resell, republish or redistribute data obtained from the Service;
• attempt to gain unauthorised access to the Service, its systems or other users’ accounts; or
• interfere with, disrupt or place an unreasonable load on the Service.

5. Licensee data and accuracy

Information about AFS Licensees is sourced from public ASIC registers and from information supplied by licensees. While we take reasonable care, we do not warrant that any information is accurate, complete, current or fit for any particular purpose. Information may be out of date or contain errors. You should verify any information directly with the relevant licensee and with ASIC before relying on it.

6. Licensee-provided content

Licensees may claim a profile and provide information about their business. Licensees are responsible for the accuracy of the content they provide. We may review, moderate, edit or remove any content at our discretion, but we are not obliged to do so.

7. Intellectual property

The Service, including its design, layout, text, graphics and compiled data (but excluding ASIC source data and licensee-provided content), is owned by or licensed to Australian Financial Freedom Pty Ltd trading as Managed Portfolios. You may not copy, reproduce, adapt, distribute or create derivative works from the Service without our prior written permission.

8. Third-party links

The Service may contain links to third-party websites. Those sites are not under our control, and we are not responsible for their content, products or privacy practices. Links do not imply endorsement.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any defects will be corrected.

10. Australian Consumer Law

Certain rights and guarantees under the Australian Consumer Law cannot be excluded, restricted or modified. Nothing in these Terms excludes those rights. Where we are entitled to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.

11. Limitation of liability

To the maximum extent permitted by law, and subject to the section above, Australian Financial Freedom Pty Ltd trading as Managed Portfolios is not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or business, arising out of or in connection with your use of (or inability to use) the Service, however caused.

12. Privacy

Our Privacy Policy explains how we collect, use and disclose your personal information and forms part of these Terms. By using the Service, you also agree to our Privacy Policy.

13. Changes to the Service and these Terms

We may change, suspend or discontinue any part of the Service, and we may update these Terms, at any time. When we update these Terms, we will change the “last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, including if you breach these Terms or if we reasonably consider it necessary to protect the Service or other users.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that place.
